1. Introduction

This Privacy Notice describes how Wound Concierge, PC (“Wound Concierge,” “we,” or “us”) collects, uses, maintains, protects, and discloses information about you when you visit woundconcierge.com (the “Website”), and through email, text, and other electronic communications between you and Wound Concierge. We respect your privacy and are committed to protecting it through our compliance with this policy.

This policy applies to information we collect: (a) on the Website; (b) in email, text, and other electronic messages between you and the Website; and (c) when you interact with our advertising on third-party websites, if that advertising links to this policy. It does not apply to information collected by us offline or through any other means, by any third party, or to protected health information collected in the course of providing medical care, which is governed by our Notice of Privacy Practices under HIPAA (see Section 5).

Please read this policy carefully. If you do not agree with our policies and practices, your choice is not to use the Website. By accessing or using the Website, you agree to this Privacy Notice. This policy may change from time to time; your continued use of the Website after we make changes is deemed acceptance of those changes.

2. Definitions

For the purposes of this Privacy Notice: “Personal Data” means any information that relates to an identified or identifiable individual. “Usage Data” means data collected automatically, generated by use of the Website or its infrastructure (for example, the duration of a page visit). “Cookies” are small files placed on your computer or mobile device by a website. “Service Provider” means any natural or legal person who processes data on our behalf, such as the third-party companies we use to facilitate the Website, host it, or analyze how it is used. “Device” means any device that can access the Website, such as a computer, cellphone, or tablet.

3. Children under the age of 13

The Website is not intended for children under 13 years of age, and no one under 13 may provide information to or on the Website. We do not knowingly collect personal data from children under 13. If we learn we have collected or received personal data from a child under 13 without verified parental consent, we will delete it. If you believe we might have any information from or about a child under 13, please contact us using the information in Section 15. Care for minors is arranged only by a parent or legal guardian.

4. Information we collect and how we collect it

We collect several types of information from and about users of the Website, including information: (a) by which you may be personally identified, such as name, postal address, email address, and telephone number; (b) that is about you but does not individually identify you, such as traffic data, referring/exit pages, and the date and time of your visit; and (c) about your internet connection, the equipment you use to access the Website, and usage details.

We collect this information: directly from you when you provide it to us (for example, when you fill in a contact, consultation-request, or careers form, or correspond with us); automatically as you navigate the Website (through cookies and similar technologies, which may collect usage details and IP addresses); and from third-party service providers such as our scheduling and payment processors.

Please do not submit medical information through Website forms. Clinical information is collected only through our secure, HIPAA-compliant patient portal and electronic health record. Payment card details are processed by our payment processor; we do not store full card numbers.

5. Health information (HIPAA & CMIA)

As a medical practice, Wound Concierge is a covered entity under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and the California Confidentiality of Medical Information Act (“CMIA”). Protected health information (“PHI”) is not collected through this Website and is not governed by this Privacy Notice. All clinical intake, scheduling details, and medical records are handled through our HIPAA-compliant systems, and our use and disclosure of PHI is described in our Notice of Privacy Practices, which is provided to every patient. To the extent information is covered by HIPAA or the CMIA, it is excluded from this policy and from the CCPA (see Section 13).

6. How we use your information

We use information that we collect about you or that you provide to us, including any Personal Data: to present the Website and its contents to you; to provide you with information or services you request from us, including scheduling consultations; to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing; to notify you about changes to the Website or the services we offer; to improve the Website and personalize your experience; in any other way we may describe when you provide the information; and for any other purpose with your consent. We may also use your information to contact you about our own services that may be of interest to you; you may opt out of such communications at any time.

7. Disclosure of your information

We do not sell your Personal Data, and we do not share it with third parties for their own marketing. We may disclose aggregated information that does not identify any individual without restriction. We may disclose Personal Data that we collect or that you provide: to contractors, service providers, and other third parties we use to support our business (such as hosting, scheduling, payment processing, and analytics providers), who are bound to keep it confidential and use it only to perform services for us; to a buyer or successor in the event of a merger, reorganization, or sale of some or all of Wound Concierge’s assets; to comply with any court order, law, or legal process, including responding to a government or regulatory request; to enforce our Terms of Service and other agreements; and if we believe disclosure is necessary to protect the rights, property, or safety of Wound Concierge, our patients, or others.

8. Cookies and tracking technologies

The Website uses cookies and similar tracking technologies (such as web beacons, tags, and scripts) to track activity and store certain information. Cookies may be “session” cookies (deleted when you close your browser) or “persistent” cookies (which remain on your Device until deleted). We use: necessary / essential cookies (session) to provide the Website’s core features; functionality cookies (persistent) to remember choices you make and provide a more personal experience; and analytics cookies to estimate audience size and usage patterns. You can set your browser to refuse all or some cookies or to alert you when cookies are being sent; if you do, some parts of the Website may not function properly. Some third-party providers may use their own cookies; we do not control these third parties’ technologies, and their use is governed by their own privacy policies.

9. Do-not-track signals (CalOPPA)

As required by the California Online Privacy Protection Act (CalOPPA), we disclose how we respond to “do not track” browser signals: at this time, we do not respond to do-not-track signals. We do, however, honor opt-out preference signals such as the Global Privacy Control to the extent required by California law.

10. Data security

We have implemented measures designed to secure your Personal Data from accidental loss and from unauthorized access, use, alteration, and disclosure. However, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Data, we cannot guarantee its security, and any transmission is at your own risk.

11. Data retention

We retain website-collected Personal Data for as long as reasonably necessary for the purposes described in this policy, to protect our legal interests, and to comply with legal requirements. Medical records are retained in accordance with California law and our record-retention policies, independent of this Website policy.

12. Links to other websites

The Website contains links to websites not operated by us, including our scheduling (Tebra/Kareo) and payment providers. If you click a third-party link, you will be directed to that third party’s site, whose privacy policy governs. We have no control over, and assume no responsibility for, the content or privacy practices of any third-party sites or services, and we advise you to review the privacy policy of every site you visit.

13. Your California privacy rights (CCPA / CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), provides you with specific rights regarding your personal information, subject to certain exceptions — including information covered by HIPAA and the CMIA, which is excluded from the CCPA’s scope. To the extent the CCPA applies to us, you have the right to: know the categories and specific pieces of personal information we have collected about you, the categories of sources, our purposes for collecting it, and the categories of third parties with whom we disclose it; request deletion of personal information we collected from you, subject to legal exceptions; correct inaccurate personal information; limit the use and disclosure of sensitive personal information to purposes permitted by law; opt out of the sale or sharing of personal information (we do not sell personal information or share it for cross-context behavioral advertising); and not be discriminated against for exercising any of these rights. To exercise these rights, submit a verifiable request by emailing info@woundconcierge.com or calling or texting (650) 880-2121; we may ask for additional information to verify your identity, and you may designate an authorized agent to act on your behalf. We will respond within the timeframes required by law.

14. “Shine the Light” (California Civil Code § 1798.83)

California’s “Shine the Light” law permits California residents to request certain information regarding a business’s disclosure of personal information to third parties for those third parties’ direct-marketing purposes. Wound Concierge does not disclose personal information to third parties for their direct-marketing purposes. California residents may nonetheless make such a request using the contact information in Section 15.

15. Changes to this Privacy Notice & contact information

We may update this Privacy Notice from time to time. We will post the updated notice on this page and revise the “last updated” date above; for material changes we will provide a prominent notice on the Website (and, where we hold your email address, notice by email) before the change becomes effective. Your continued use of the Website after changes are posted constitutes acceptance.
